Selling RMXP's SE and BGS

I'm sure judges go through lawschool to convict someone of copyright infringement over a sound clip that's less than a second long.
haha, I just think it's funny, I'm not trying to argue here. You are right though, people will sue over anything now-a-days.
 
Some musicians had trouble over 10 seconds of sampled sounds from songs which weren't even recognizable.
Now, coming back to the practical side, honestly, Enterbrain won't come up knock at your door after selling an amateur game for some bucks and just a couple of copies of it using their sounds. I doubt they will even know.
Now that would be a different story if you would have a game company and you would sell "pro" games. (I state the diff. between pro and amateur here, but in my opinion the only big diff. between your amateur games and pros is that you people aren't getting paid for it, and you just do it because you love it.)
I would say, use the sounds, but try to use custom music, and even concerning the sounds, at the worse of cases you can ask for them, I'm sure someone will supply you with a couple. And Cruelty, although you are right, right now intellectual property is full of laws.

What I was asking was this:

Obviously, there are lot of people making fangames on this site. It's also obvious that selling fangames is illegal, but is making them? I don't think so. What if they use a script in their fangame, that they don't plan to sell, just for us on rmxp.org to play?

Oh, and no more of the "I've told you 100 times" stuff, please.
 
This is all so premature. Why does a thread about selling this/that/the other thing seem to come up every week when I can only think of one RMXP game (Aveyond) that has actually been sold?

In regard to fangames, this forum has always been willing to tolerate the ambiguity around them. You won't be able to sell them without getting in trouble down the line, but we don't mind if you make them. However, even if someone made some custom sound effects or music that they never planned on selling doesn't mean they're fine with others selling it. Doesn't work that way.

If you ever do get a game to the point where it's completely finished and ready to sell (which is such a rare thing that I still can't believe the ramifications of it are discussed so much here), you do not sell anyone's custom resources without their permission. Period. End of Discussion. There's no elaborate loophole that will get around this.
 
I'm well aware of that. I happen to be making my own, original game with original graphics, BGMs, and now, SE as well. My friend Andy "Alive!!!" Frank is helping me.

EDIT: Oh yeah, and everything is going relatively smooth, too!......Relatively.....

The playstation 2 version was much better. And I don't think it has as many restrictions as RMXP in terms of commercial sale for the PC but I'm not sure.
