Some musicians had trouble over 10 seconds of sampled sounds from songs which weren't even recognizable.
Now, coming back to the practical side, honestly, Enterbrain won't come up knock at your door after selling an amateur game for some bucks and just a couple of copies of it using their sounds. I doubt they will even know.
Now that would be a different story if you would have a game company and you would sell "pro" games. (I state the diff. between pro and amateur here, but in my opinion the only big diff. between your amateur games and pros is that you people aren't getting paid for it, and you just do it because you love it.)
I would say, use the sounds, but try to use custom music, and even concerning the sounds, at the worse of cases you can ask for them, I'm sure someone will supply you with a couple. And Cruelty, although you are right, right now intellectual property is full of laws.
